ISLAMABAD: The Islamabad High Court (IHC) has barred authorities from taking coercive measures against cafes and restaurants that are legally operating and serving sheesha under permits or licences issued by competent authorities.
In its written order, the court clarified that establishments operating lawfully and serving sheesha in accordance with valid permits should not face coercive action.
The IHC also directed the district administration to formulate comprehensive rules and regulations for sheesha cafes within one month. The relevant authorities were asked to pursue the finalisation of a proper regulatory framework and submit a compliance report.
At the same time, the court instructed Islamabad Police to continue lawful action against illegal sheesha-related activities and narcotics offences. It made clear that action could be taken where any establishment was found violating the law or the terms of its permit.
The court stressed that authorities must also protect public health and safeguard young people from smoking, substance abuse and other unlawful practices.
The written order noted that the Prohibition of Sheesha Smoking Rules 2023 remain pending before the federal government and have not yet been finalised.
